1. Agreement to Terms

By accessing or using AFH Manager ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

AFH Manager provides cloud-based software for managing adult family homes, including features for resident management, medication tracking (eMAR), care planning, compliance tracking, and staff management.

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining the security of your login credentials
• Notifying us immediately of any unauthorized access
• Ensuring all users under your account comply with these terms

4. Subscription and Billing

4.1 Subscription Plans

AFH Manager is offered as a subscription service. Current pricing and features are available on our pricing page. We reserve the right to modify pricing with 30 days' notice.

4.2 Payment Terms

• Subscriptions are billed in advance on a monthly basis
• All fees are non-refundable except as expressly stated
• You authorize us to charge your payment method automatically
• Failed payments may result in service suspension

4.3 Cancellation

You may cancel your subscription at any time. Access continues until the end of your current billing period. No refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Share account credentials with unauthorized parties
• Reverse engineer or copy our software
• Use the Service to store or transmit malicious code

6. Data Ownership and Responsibilities

6.1 Your Data

You retain ownership of all data you enter into the Service. You grant us a limited license to use this data solely to provide and improve the Service.

6.2 Data Accuracy

You are responsible for the accuracy and completeness of data entered into the Service. AFH Manager is a tool to assist with management and is not a substitute for professional judgment.

6.3 Regulatory Compliance

You are responsible for ensuring your use of the Service complies with all applicable healthcare regulations, licensing requirements, and privacy laws. Our Service is designed to assist with compliance, but compliance remains your responsibility.

7. Intellectual Property

The Service, including its design, features, and content, is owned by AFH Manager and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive license to use the Service as intended.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFH MANAGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from your use of the Service shall not exceed the amounts paid by you in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AFH Manager, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes when possible.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, you may request a copy of your data within 30 days.

13. Governing Law

These Terms shall be governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Washington State.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
